Article28Delayedpayments

28.1IftheperiodlaiddownforpaymentintheSpecialConditionshasbeenexceeded,andthecontracthasnotgivenrisetoanyclaim,theSuppliershallqualifyforinterestcalculatedprorataonthebasisofthenumberofcalendardaysbywhichpaymentisdelayed,attherediscountrateoftheissuinginstituteoftheStateinwhichtheSupplierhashisregisteredoffice.

28.2Anydefaultinpaymentofmorethan120daysfromtheexpiryoftheperiodlaiddownintheSpecialConditionsshallentitletheSuppliereithernottoperformthecontractortoterminateit.

ACCEPTANCEANDMAINTENANCE

Article29Delivery

29.1TheSuppliershalldeliverthesuppliesinaccordancewiththetermsspecifiedinthecontractandthesuppliesshallremainattheriskoftheSupplieruntilprovisionalacceptance.

29.2TheSuppliershallprovidesuchpackagingofthesuppliesasisrequiredtopreventtheirdamageordeteriorationintransittotheirfinaldestinationasindicatedinthecontract.Thepackagingshallbesufficienttowithstand,withoutlimitation,roughhandling,exposuretoextremetemperatures,saltandprecipitationduringtransitandopenstorage.Packagesizeandweightshalltakeintoconsideration,whereappropriate,theremotenessofthefinaldestinationofthesupplies,andthepossibleabsenceofheavyhandlingfacilitiesatallpointsintransit.

29.3Thepackaging,markinganddocumentationinsideandoutsidethepackagesshallcomplywithsuchrequirementsasshallbeexpresslyprovidedforintheSpecialConditions,subjecttoanyvariationssubsequentlyorderedbytheProjectManager.

29.4NosuppliesshallbeshippedordeliveredtotheplaceofacceptanceuntilaconfirmationinwritinghasbeenobtainedbytheSupplierfromtheProjectManagerthatthesuppliesmaybedelivered.TheSuppliershallberesponsibleforthedeliveryattheplaceofacceptanceofallsuppliesandSupplier'sequipmentrequiredforthepurposeofthecontract.

29.5EachdeliverymustbeaccompaniedbyastatementdrawnupbytheSupplier.ThisstatementasstatedintheSpecialConditions.
