AsIseeit,thetypeofcrimeisboominginanincreasinglyspeedwiththeinternetandcyberspacehavealreadybecomeoneindisposablepartofeverycontemporaryindividuals'life.Asaresult,on-linefraud,asonenewtypeofcrimeisplayingamoreandmorepivotalroleinfuture'soffence.Consequently,onefixedpunishmentshoulebeputforthtocurbthepotentialproliferationofthemainstreamofthefuture'crime,i.e.thecrimeofthecyberspace.Futher,aslegilationisonemajorhandintermsofkeepingthepublic'ssecurityandthepreciouslife,onefixedlawisnotunnecessaryforeverynationsoftheworld.
However,asweallliveinademocraticandenlightenedsociety,moreandmorepeople,majorlyinthedevelopedcountriesincreasinglyconcernaboutthehumanityeventheoffenders'.Undeniably,circumstanceandmotivationsasanessencialfactorswhichmayluremantocommitacrimeincludingthebackgroudofthecriminals,suchaswhetherthecriminalswererearedbyasingle-parenthouseholds.Butnomatterhowsignificanttheseluremaybe,itjusthaveacertaineffectwhenverdicting.
So,lawisalwaysthelaw,itshouldbeobjectiveandbalancedtoshowitsauthority,whichcansometimesmakeitbealittlecallous.
